To have a Folder!

Buy a folder where you'll put all the documents you will gather throughout the whole process. There are many!

First of all you must include:

  • Passport of both parents (original and photocopies. Have two copies ready to begin with)
  • Family book, if you have it (original and photocopies of ALL the written pages. Have two copies ready to begin with)

In some of the paperwork you require photocopies and not in others, depending on the way of working of each center.

Documents given in the hospital

Some hours after the birth you will be given two documents:

  • Maternity medical report (yellow paper).
  • Statistical Bulletin (red paper)

Leaving the hospital, at the administration desk you will be given a:

  • Hospital discharge report (informe de alta hospitalaria)

The hospital will have already filled out some information but you must complete it before delivering it at the Civil Registry (Registro Civil)
It is long to fill so take your time to do it!

Please ensure that the yellow paper is signed by the doctor or the midwife before leaving the hospital. If it is not signed when it is first handed out to you, don’t worry because they will probably sign it at a later visit.

Birth registration at the civil registry (registro civil)

It is necessary to register the baby in the city where they were born or in the city where they will live in.

Documents needed:

  • The passport of both parents
  • Maternity medical report (yellow paper)
  • Statistical Bulletin (red paper)
  • Family book (if you already have it)

If you are married, it suffices for one of the parents to go to the Civil Registry. If not married, or you are foreigners, both of you will be required to go. If you would like to change the order of the baby's surnames, both parents will also be required to go in person.

This formality must be done 24 hours after the baby was born and within a maximum of 30 days.

Remember to make copies of the page where the details of the baby appear and put them in the folder.

Get a birth certificate in the Registry

In the Civil Register you will also get the “BIRTH CERTIFICATE". You may need it to make the passport. You may ask for a couple of copies. (They can give you an European one, written in many languages)

Getting a medical certificate from your family doctor

You must arrange an appointment with your family doctor at the CAP (Centro de Atención Primaria) to get the medical certificate for your maternity leave.

Documents needed:

  • Hospital discharge report (informe de alta hospitalaria)
  • The mother's passport or identity card (if you're not actually going in person)

It is possible for somebody else to go and get the maternity leave medical certificate in case the mother cannot do it herself.

Company Certificate (mother and / or father)

COMPANY CERTIFICATE OF MOTHER:

This procedure does not have to realize freelance or who are not working.

Maternity leave works similar to a sick leave: the company takes over the salary of the first 2 days and the rest (up to 16 weeks) is covered by Social Security. It is therefore necessary that the human resources manager or the private agency that handles the administrative issues prepare a certificate stating the mother's salary.

Documents needed:

  • Family book
  • Mother’s NIF, NIE or Passport (only if someone else is getting this document)
  • Baja de maternidad (Medical certificate from your family doctor). This document was gotten one step before.

IMPORTANT: In case you are getting the unemployment benefit, you must go the INEM office. The documents you need to bring are the same. Find your office: http://www.sepe.es/direccionesytelefonosWeb/jsp/JSP_index.jsp

PARENT COMPANY CERTIFICATE

This procedure is not necessary if the father is not working or he is is freelance

Documents needed:

  • Family book
  • Mother’s NIF, NIE or Passport (only if someone else is getting this document)

IMPORTANT: In case you are getting the unemployment benefit, you must go the INEM office. The documents you need to bring are the same. Find your office:

To register the baby in the local census

 It is necessary to register the baby at the city council. If it is a big city you will have to go to your own district.

Documents needed:

  • Passport or identity card of one of the parents
  • Family book

You will need 2 copies of the Local Census: one for the Social Security and the other to get the baby’s sanitary card.

Social Security forms

There are three formalities to do at the "Istituto Nacional de la Seguridad Social" (INSS):  maternity benefits, paternity benefits and registering the baby at the social security.

Necessary documents in order to claim maternity benefits: 

Documents needed:

  • Mother's passport or identity card
  • Family book
  • "Baja por maternidad". Medical certificate from the family doctor.
  • If the mother is a salaried employee, her company’s certificate (obtained in a previous step)
  • If the mother is freelance, the last 3 receipts of the payment of social security (you can get them at the bank)
  • The form "Solicitud de maternidad, adopción o acogimiento" (it is given in the Social Security but the mother must sign it)
  • The form "Modelo 145" filled (it is given in the Social Security but the mother must sign it)

Necessary documents in order to claim paternity benefits:

Parental leave works exactly like maternity leave, only that the duration is shorter (15 days).

It is possible that the father gets part of the days of the mother's permission if they want. This is decided on the form to be filled for Social Security.

There is the possibility of spending the days of the permit as part-time rather than full time.

Documents to take

  • Father's passport or identity card
  • Family book
  • The Local Census of the baby (obtained in a previous step)
  • If the father is a salaried employee, his company’s certificate (obtained in a previous step)
  • If the father is freelance: the last 3 receipts of the payment of social security (you can get them at the bank)
  • The “Solicitud de paternidad” (paternity claims form) which you will get it in the Social Security
  • The form “Modelo 145″ which you will also get at the Social Security

Necessary documents needed to register the baby at the Social Security:

  • Family book
  • Social Security card under which the baby will be registered (usually the mother’s)
  • "Impreso de afiliación del bebé como beneficiario de la Seguridad Social" (Baby's registration form as a beneficiary of the Social Security) which you will also get at the social security.

baby's healthcare card and appointment with the pediatrician

You need to go to your CAP (Centro de Atención Primaria). Find yours at https://salut.gencat.cat/pls/catsalut/cawpk500.inici

Documents needed:

  • Family book
  • Baby's registration form as a beneficiary of the Social Security (obtained in the previous step)
  • Baby's local census.
  • Application form for the baby's healthcare card (which you will be given at the CAP)

Tax Benefits

With the current crisis, there is only one sort of maternity tax benefit at present in Spain. It is 100€ per month and can only be obtained if the mother is working and during the first three years of the baby. It is called "Deducción por madre trabajadora" and it must be included in the yearly income statement ("declaración de la renta") in the years you benefit from it. All the formalities must be done at the Agencia Tributaria (AEAT).

Documents needed:

  • Mother's identity card (this formality can also be done by the father)
  • Family book
  • Mother's Social Security Number
  • Bank account number where we want to receive the payment.
  • Model 140 application form (can be downloaded online)

It is only necessary to fill in the application form the first year and from then on the request is renewed automatically. The benefit is received the month immediately after.
